Еще раз о понятии гражданско-правового договора
Аннотация
Проведен анализ научных взглядов на понятие и сущность гражданско-правового договора. Исследованы научные подходы к определению договора дореволюционных российских авторов, представителей советской юридической школы и современных исследователей данного понятия. Обоснован тезис о том, что в юриспруденции принято, согласно правилам юридической техники, каждому юридическому явлению «присваивать» самостоятельное юридическое понятие. Аргументирован критический подход авторов к научной позиции некоторых ученых, обосновывающих многозначность понятия гражданско-правового договора. Сформулированы конкретные предложения по внесению изменений в формулировку понятия договора в ст. 420 ГК РФ.
