Использование личных доказательств при доказывании воли сторон договора

Аннотация
Рассматривается проблема использования личных доказательств при доказывании воли сторон договора. Анализируются позиции ученых-юристов по данному вопросу, а также судебная практика. В ходе анализа выявляется отсутствие единого подхода в судебной практике по использованию отдельных видов доказательств, в связи с чем выдвигается авторское видение проблемы. Помимо этого, затрагиваются вопросы недействительности сделок с пороком воли (мнимые, притворные сделки, сделки, совершенные лицом, не способным понимать значение своих действий и руководить ими). Отдельно поднимается проблема допустимости использования посмертной судебно-психиатрической экспертизы.
