Взаимосвязь правового принципа и правовой презумпции в рамках свойства презумптивности конституционных принципов

Аннотация
Дается характеристика свойства презумптивности конституционных принципов, в рамках которого исследуются аспекты взаимосвязи правового принципа и правовой презумпции, которая является инструментом контроля за надлежащим соблюдением субъектами правоотношений положений конституционных принципов. При исследовании взаимосвязи правовой презумпции и правового принципа рассматривается понятие правовой презумпции, ее отраслевое закрепление, затрагиваются вопросы презумптивного состава правоотношений, а также анализируются позиции правоведов в рамках рассматриваемых вопросов.
