Features of conduct of chiefs of enterprises and creditors in conditions of insolvency

Abstract

In the article on the basis of the conceptual means of the new institutional economics the features of contracting are researched within the framework of institute of bankruptcy. The possibility of opportunistic conduct of chiefs of the crisis enterprises and creditors is argued; the most typical forms of opportunism are characterized; the method of maintenance of observance of the established rules is offered at the expense of amplifi cation of threat of application of sanctions.
