Abstract

Subject. The subject of this study was the analysis of joint offset transactions implemented by government customers during the valid period of the relevant legislation on the contractual system.
Purpose. The paper analyses the theoretical foundations of joint tenders for the conclusion of offset contracts and also compares them with other joint procedures provided for by the contractual legislation of the Russian Federation, provides an analysis of completed purchases for the execution of transactions with counter investment obligations and an expert assessment of projects implemented in this paradigm.
Methodology. In this work we used empirical research methods and the method of content analysis. Its application is aimed at studying the content of notifications on joint offset tenders, the data on which is available in the Unified Information System in the field of procurement, and documents regarding other competitive procedures.
Conclusions. The conducted study confirms the concerns of the Antimonopoly Service of Russia that intersubject joint contracts are disavowed as a tool for the development of the innovation sector and import substituting industries. The subjects of the concluded contracts relate to competitively capacious commodity markets, which does not allow implementing the principle of competition development. This requires a revision of approaches to meeting the customers’ needs for products through the conclusion of contracts with counter investment obligations and management of the public procurement industry with their help. The legislatively specified goal of the process of purchasing goods, works, and services at the expense of budgetary funds is not to narrow the capacity of bidders, but, on the contrary, to become a business lift for economic agents.
