The alienation of the rights to life and health: the institutional dimension

Abstract

Purpose: the article views the property rights of the individual at various levels: physiological, intellectual and spiritual. Discussion: the authors consider alienation of intangible property rights as one of the criteria necessary for its commercialization. The article deals with intangible alienation of rights and material alienation of the objects of the individuals property. The authors consider material alienation of objects from the position of concomitant alienation of rights. In order to obtain income rights, an individual alienates his rights partially – this is the principle. The share of alienation of information and other types of intangible property is growing in the modern information society. Nowadays the development of somatic rights is taking place; the state becomes an institution that regulates the right of alienation of somatic rights. In the process of research, the authors used the following general scientific methods: analysis, synthesis, abstraction and analogy. When considering the alienation of somatic rights, the researchers used systematic approach and classification. Results: the authors identified types of alienation of somatic rights, as well as the boundaries of somatic rights in various states, which allow to conclude, that the commercialization of somatic rights is possible. The authors also revealed that by moving to the information society, the physiological level of alienation is no longer valid, but is transformed with the use of new technologies, creating new forms of alienation of material and non-material property.
