Unfair competition: essence, signs, forms

Abstract

Importance: unfair competition as a direction of analysis to identify risks and threats to the economic security of an organization in the context of globalization and digitalization of the economy. Purpose: to study the essential characteristics of unfair competition from the point of view of both legal and economic categories, to identify the features of the forms (acts) of unfair competition in various fields. Research design: аs part of creating an effective system for ensuring the economic security of an organization, the authors propose to identify risks and threats from such an economic phenomenon as unfair competition through an analysis of its essential characteristics, key features and specific features inherent in specific forms of its manifestation in a competitive market. This approach makes it possible to form a complex system of signs of manifestation of acts of unfair competition for further assessment of the likelihood of realization of risks or threats on their part, which will allow mobile response to the destructive impact of competitors. Results: the authors formulated a set of distinguishing features of various forms of manifestation of unfair competition. An assessment was made of the current legislation in the field of competition protection for clarity for economic entities, the proper level of detail in the framework of the constantly expanding capabilities of organizations both in the framework of fair and unfair competition in the context of globalization and digitalization of the economy.
