Actual problems of abuse and application of schemes by customers: causes and their elimination

Abstract

Subject: actions of customers responsible for compliance of procurement documentation with the provisions of legislation in the field of procurement for state and municipal needs. Objective: in modern conditions, the issue of the effectiveness of spending budget funds, including through the contract system, is acute, therefore, special attention must be paid to the problem of corruption and strengthening the administrative mechanisms that are aimed at to counter customer abuse in the area under study. Research design: the methodological approach to the analysis includes three stages. At the first stage, the process of reforming legislation in the field of procurement for state and municipal needs, including their transition to electronic trading platforms, is being investigated. The second stage includes an analysis of illegal actions on the part of customers during the bidding period with the full-time participation of representatives of economic entities, an assessment of the effectiveness of the transition to conducting competitive procedures in electronic form is given. At the third stage, administrative mechanisms that stimulate customers are considered to comply with the provisions of the legislation in the field of procurement. However, during the monitoring conducted on the official website of the Unified Information System in the field of procurement, actual problems in the field of procurement were identified, the elimination of which the reforms carried out by the state did not contribute. The conducted research allows the author to come to the conclusion that it is necessary to clarify the administrative responsibility for certain offenses in the field of procurement on the part of customers. Results: revealed ways of abuse and use of illegal schemes by state and municipal customers when preparing documentation for bidding. Conclusion reached that the use of administrative fines disproportionate to the committed offense does not allow preventing the commission of similar offenses by unscrupulous customers in the future, in this regard, the State needs to improve administrative mechanisms, the end result of which, according to the author, will be, among other things, the expansion of the potential circle of participants in competitive procedures.
